Service Policy

The Japan Foundation Japanese-Language Institute, Urawa (referred to hereafter as ‘the Institute’) sets out as below the service policy (referred to hereafter as ‘this policy) for the use of the smart phone application that the Institute offers ‘Challenge with Erin - Japanese Language Test’ (referred to hereafter as ‘this application’).
It is considered that users of this application have agreed to this policy in the event they download and use this application. In addition, the Institute retains the right to change the contents of this policy without notice.

1. Copyright

The copyright of the information contained in this application and all other rights related to this application belong to the Institute and authorised rights holders. In addition, the content of this application may not be reprinted or duplicated, in whole or in part, other than for personal use.

2. Exemption from Responsibility

• (1) While utmost care is taken regarding the accuracy of the content of this application and its security, this does not guarantee the elimination of all possibilities of the occurrence of error in the content, or error in the content due to falsification by a third party or other uncontrollable factors. The Institute bears no responsibility for damages incurred by users of this application from use of this application and its content.
• (2) The contents of this application are subject to change or deletion without prior notice. The services provided in connection with this application may be stopped in whole or in part due to system failure or maintenance. The Institute bears no responsibility for any damages incurred due to such content changes or service stoppage.
• (3) The Institute bears no responsibility for any damages incurred in such cases as leakage of email addresses or passwords, unauthorized use, illegal access to the user’s communications or data, or unauthorized modification.

3. Governing Law and Jurisdiction

Disputes arising between the Institute and the user regarding the services provided in connection with this application or these Terms of Use shall be governed by the laws of Japan and subject to the exclusive jurisdiction of the Saitama District Court in Japan in the first instance.
